Stop The Take It Down Act: Protect DMs and Free Speech

The Take It Down Act threatens private messaging and free speech online. Trump supports the bill because he wants to silence his critics online, already signaling the worst, repressive ways this legislation could be used.

The bill would require platforms to remove nonconsensually distributed intimate imagery (NDII) within 48 hours of notice by a user, but provides no exception for encrypted private messages.  This means companies would be required to abandon end-to-end encryption so they can read and moderate your DMs. The bill also has no safeguards against false reports being used to remove protected and already often censored speech, like sex education, reproductive healthcare resources, or just talking about LGBTQ communities online. Sex workers would be particularly at risk of having their content flagged and removed through false reports.

The Take It Down Act is a dangerously flawed solution to a serious problem. We have better options, like the DEFIANCE Act, which would support victims of AI generated NDII in suing their abusers. Tell Congress: don’t accept a solution to NDII that sacrifices encryption and free speech!

Introduce yourself, be polite, and say:

“I urge you to oppose the Take It Down Act, a bill that threatens end-to-end encryption and will allow Trump to censor his critics online. Malicious actors, including the president, will abuse takedowns to remove content they dislike and will face no penalties for doing so. Take It Down is an unacceptably dangerous solution to this pressing problem.”
